I am a constituent. I am contacting you about a pending federal rulemaking: the Drug Enforcement Administration has proposed permanently placing tianeptine in Schedule I of the Controlled Substances Act (Docket DEA1596; 91 FR 42150; Federal Register Document 2026-13821). Public comments close 11:59 p.m. Eastern Time on August 7, 2026.

Schedule I is the most restrictive federal category. If finalized, its controls and sanctions would apply to manufacture, distribution, import, export, research, chemical analysis, and possession. 

The proposed rule acknowledges that tianeptine is approved as a prescription antidepressant drug in European, Asian, and Latin American countries, typically for depression, and that HHS found more patients sought tianeptine for perceived therapeutic purposes than for recreation.

I am not asking anyone to defend mislabeled retail products or unsafe high-dose use. Those harms are real and should be addressed through targeted FDA enforcement, manufacturing standards, accurate labeling, and other proportionate controls. I am asking that the most restrictive available federal control not be applied to a substance prescribed as medicine abroad and studied in humans.

I respectfully ask your office to urge DEA to withdraw or delay the proposed rule, to evaluate less restrictive alternatives on the record, and to protect lawful medical and scientific research.
